1. About us and these terms

This website is operated by We Sell Any Fan, 22 Charlton Road, Wantage, OX12 8HG, United Kingdom.

We operate an online store supplying air handling unit and ventilation components to businesses in the United Kingdom, including EC fans, centrifugal and axial fans, dampers, actuators and airflow pressure switches. Products are available to purchase directly through the website, and we also supply against written quotation. We source hard-to-find, obsolete and like-for-like replacement components to customer specification.

These terms apply to your use of this website and to every contract for the supply of products between us. By using the site or placing an order you accept them. Please read them and keep a copy.

We may update these terms from time to time. The version in force is the one published on the site at the moment you place your order.

2. Business customers only

We supply to businesses. By placing an order you confirm that you are acting in the course of a business, trade, craft or profession, and not as a consumer.

The cancellation rights available to consumers under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to orders placed with us.

3. Using this website

We grant you permission to access the site and to view or print its content for your own business purposes. You may not copy, republish, sell, or systematically extract our content, product data or images without our written permission.

You agree not to use the site unlawfully, to introduce malicious code, to attempt to gain unauthorised access, to scrape or harvest data, or to interfere with its operation.

We own or licence all intellectual property in the site, its content, and our name and logo. Manufacturer names, part numbers and trade marks referred to on the site belong to their respective owners and are used to identify products we supply.

4. Products and information

We take care to describe products accurately, but manufacturer data, drawings, dimensions and performance figures are provided for guidance. Manufacturers may alter specifications without notice, and we do not warrant that published data is free from error. Images are illustrative.

All products are subject to availability. We may discontinue any product at any time.

5. Prices and payment

Prices are shown in pounds sterling and exclude VAT unless stated otherwise. VAT is added at the applicable rate. Prices exclude delivery unless stated.

We may change prices at any time. We reserve the right to correct pricing errors, including after an order has been placed. If a price is materially wrong we will contact you before proceeding, and you may cancel the affected order.

We accept payment by Visa, Mastercard and American Express, processed by Stripe. Payment is due in full before dispatch unless we have agreed credit terms in writing.

6. Quotations and orders

Written quotations are valid for 30 days unless stated otherwise, and are subject to the products remaining available from our supplier at the quoted price. We may withdraw or revise a quotation at any time before you accept it.

Your order is an offer to buy. A contract is formed only when we send written confirmation that we have accepted your order, or when we dispatch the goods, whichever happens first. Payment being taken at checkout does not by itself constitute acceptance.

We may refuse or cancel any order, including where the product is unavailable, where the price was stated incorrectly, or where we suspect fraudulent use of a payment method. If we cancel, we will refund any payment taken in full.

7. Suitability and selection

Where we supply against a part number, specification or duty that you provide, you are responsible for the accuracy of that information and for confirming that the product is suitable for your intended application.

Any technical guidance we give is offered in good faith to assist you. It does not transfer responsibility for product selection to us.

If you are replacing an existing unit, please confirm before ordering that dimensions, mounting arrangement, electrical supply, rotation and discharge orientation match your installation.

Installation must be carried out by a competent person in accordance with the manufacturer’s instructions and applicable regulations.

8. Delivery, title and risk

Delivery is to the address you give us at the point of order.

Any lead time, delivery date or dispatch date we give is an estimate made in good faith and is not guaranteed. Time of delivery is not of the essence.

We are not liable for delay caused by our suppliers, manufacturers, carriers, or any cause beyond our reasonable control. Delay does not entitle you to cancel the order, reject the goods, or claim compensation. Where a delay becomes substantial we will discuss the options with you, which may include sourcing an equivalent product.

Risk in the goods passes to you on delivery to your address, or on collection.

Title to the goods does not pass to you until we have received payment in full. Until then you must store the goods so that they remain identifiable as ours, and we may enter your premises to recover them.

You must inspect the goods on delivery and notify us in writing of any shortage, damage or incorrect item within three working days. Claims made after that period may not be accepted.

9. Returns and cancellation

Stock items. Unused stock items in their original packaging may be returned within 30 days of delivery, provided you obtain a returns authorisation from us first. A restocking charge of up to 20% may apply, and return carriage is at your cost. Where delivery was charged on the original order, that charge is not refunded on a change-of-mind return.

Sourced and special order items. Products obtained specifically for your order, including bespoke selections, obsolete units, discontinued models and any item we do not hold as stock, cannot be cancelled or returned once the order has been accepted, unless the product is faulty or does not match the specification we confirmed. This is because these items are bought in for you and cannot be resold.

Faulty or incorrect goods. Where a product is faulty, or we have sent the wrong item, we will cover return carriage and no restocking charge applies. Nothing in this section affects your rights in respect of goods that are faulty or not as described.

10. Warranty

Products are supplied with the manufacturer’s warranty, which is 12 months from delivery unless stated otherwise. Warranty claims are subject to the manufacturer’s terms and their assessment of the fault.

The warranty does not cover fair wear and tear, incorrect installation, unsuitable application, operation outside the product’s stated performance range, failure to maintain the equipment, damage occurring after risk has passed, or modification of the product.

Where a product is found to be faulty within the warranty period, our obligation is limited to repair, replacement, or refund of the price paid, at our option.

11. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the terms implied by section 12 of the Sale of Goods Act 1979, or for any other liability which cannot lawfully be limited or excluded.

Subject to the above, we are not liable to you for any of the following, whether arising in contract, tort including negligence, breach of statutory duty or otherwise: loss of profit, loss of revenue, loss of business, business interruption, loss of production, loss of anticipated savings, loss of contract or opportunity, loss of goodwill, wasted expenditure, the cost of removing or reinstalling equipment, or any indirect or consequential loss.

Subject to the above, our total liability in respect of any order is limited to the price you paid for the products supplied under that order.

You should ensure you hold appropriate insurance covering losses that may arise from equipment failure at your premises or those of your customers.

12. Website availability

We do not guarantee that the site will be available at all times or free from errors. We may change, suspend or withdraw all or part of it without notice, and we are not liable for any loss arising from it being unavailable.

13. Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms, your misuse of the site, or your infringement of a third party’s rights.

14. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including supplier or manufacturer failure, shortage of materials, transport disruption, industrial action, fire, flood, epidemic, or the act of any government or authority.

15. Privacy

We handle personal information in accordance with our Privacy Policy and Cookie Policy, which form part of these terms.

16. General

These terms, together with our quotation and order confirmation, form the entire agreement between us and supersede any previous discussion or correspondence. Any terms you seek to impose, including those printed on a purchase order, do not apply unless we agree to them in writing.

If we do not enforce a provision, that is not a waiver of it.

If any provision is found unlawful or unenforceable, the rest remain in force.

We may transfer our rights and obligations to another business. You may not transfer yours without our written consent.

Nobody other than you and us has any right to enforce these terms.

17. Governing law and disputes

These terms and any contract between us are governed by the laws of England and Wales.

If a dispute arises, both parties agree to try to resolve it by discussion first, allowing 30 days from written notice, before starting court proceedings.

The courts of England and Wales have exclusive jurisdiction.
